The Minnesota Pollution Control Agency (MPCA) has issued a “2010 Compliance Calendar for Industrial Stormwater” as a guide for companies and sites that are subject to industrial stormwater permitting requirements.  The calendar can be found at:  The MPCA notes that the compliance calendar is a summary of applicable permit terms and regulations and it should not necessarily be relied on in lieu of the permit.  Nonetheless, the Compliance Calendar is a handy tool for businesses that are subject to permitting requirements.

The MPCA is the lead state agency that enforces stormwater permits and regulations in the State of Minnesota.  The U.S. Environmental Protection Agency (EPA) and certain units of local government also have jurisdiction over stormwater discharges.  Although the industrial stormwater permit is relatively new in Minnesota, parties who are subject to the permit may expect the MPCA to conduct inspections of their facilities to determine their compliance status.  In the past five years the MPCA has undertaken dozens of enforcement cases on construction sites where stormwater permits were required.

At Hessian & McKasy, P.A. our environmental lawyers assist our clients in auditing their operations to determine their compliance status with all types of environmental regulations including industrial and construction stormwater permits.  In cases where the MPCA or the U.S. Environmental Protection Agency initiates enforcement action the environmental law practitioners at our firm represent our clients in administrative proceedings.  For more information about the Environmental Law Attorney Practice Group at Hessian & McKasy please visit:
